FIDIC Contract (EN)
A suite of standard-form construction contracts published by the Fédération Internationale des Ingénieurs-Conseils (FIDIC), headquartered in Geneva. FIDIC contracts are the global standard for international construction and engineering projects, particularly dominant in the Middle East and Africa. The main forms include: the Red Book (employer-designed works), Yellow Book (design-build/plant), Silver Book (EPC/turnkey), and Gold Book (design-build-operate). Each follows a multi-tiered dispute resolution mechanism: Engineer's determination → Dispute Avoidance/Adjudication Board (DAAB) → amicable settlement → arbitration. The 2017 Second Edition introduced significant changes to claims procedures, including time-bar provisions and the standing DAAB requirement.

Under FIDIC 2017 Sub-Clause 20.2.1, the contractor must give notice of a claim within 28 days of becoming aware (or when it should have become aware) of the event giving rise to the claim. Failure to comply means the contractor 'shall not be entitled to any additional payment, and the Time for Completion shall not be extended' — effectively a complete time-bar. However, some GCC jurisdictions (notably under UAE civil law principles) may not enforce strict time-bars if they are considered to constitute an unfair forfeiture of substantive rights. This remains a contested area of construction arbitration practice.
