International Arbitration (EN)
A private, binding dispute resolution mechanism where parties submit their dispute to one or more arbitrators whose decision (the 'award') is final and enforceable internationally under the New York Convention (1958). Arbitration is the dominant dispute resolution method for cross-border commercial disputes in the GCC, preferred for its neutrality, enforceability, confidentiality, and the ability to select arbitrators with industry expertise. Key arbitral institutions for GCC disputes include: ICC (International Chamber of Commerce), DIAC (Dubai International Arbitration Centre), LCIA (London Court of International Arbitration), SCCA (Saudi Center for Commercial Arbitration), QICCA (Qatar International Centre for Conciliation and Arbitration), and the DIFC-LCIA Arbitration Centre.

Yes. Both the UAE and Saudi Arabia are signatories to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. A DIAC or ICC award seated in Dubai can be enforced in Saudi Arabia through the Saudi Enforcement Court, subject to the limited grounds for refusal under the Convention (e.g., lack of valid arbitration agreement, procedural irregularity, public policy violation). The GCC Convention for the Execution of Judgments (Riyadh Convention) provides an additional enforcement pathway. However, Saudi courts have historically applied public policy grounds more broadly than other jurisdictions — particularly where awards involve interest or are perceived to conflict with Sharia principles.
