A pre-agreed sum specified in the contract as compensation for a specific breach — most commonly for delay in achieving project completion (delay LDs) or failure to meet performance specifications (performance LDs). In construction contracts, delay LDs are typically calculated as a daily or weekly rate, often expressed as a percentage of the contract price (commonly 0.1%-0.5% per day) subject to an aggregate cap (typically 10-20% of the contract price). The purpose is to provide the employer with a genuine pre-estimate of loss without needing to prove actual damages.
