Droit de la concurrence aux EAU
Federal Law No. 4 of 2012 (as amended by Federal Decree-Law No. 36 of 2023) regulating anti-competitive practices, abuse of dominant position, and economic concentrations (mergers) in the UAE. The law prohibits: cartels and anti-competitive agreements (price fixing, market sharing, bid rigging), abuse of dominant market position, and concentrations that substantially lessen competition. The Ministry of Economy's Competition Regulation Committee is the enforcement authority. Merger control: transactions exceeding specified thresholds (combined UAE turnover or market share) require pre-completion notification and clearance.
