Clause de non-concurrence
A contractual provision restricting an employee's ability to work for a competitor or start a competing business after leaving employment. Under UAE Labour Law (Article 10 of Federal Decree-Law No. 33 of 2021), non-compete clauses are enforceable if they are: (1) in writing, (2) limited to a maximum of 2 years, (3) restricted to a specific geographical area, and (4) confined to work that is the same nature as the employer's business. The restriction must be proportionate to the employer's legitimate interest in protecting trade secrets, confidential information, or client relationships. Courts will not enforce clauses that are unreasonably broad in scope, duration, or geography.
